1. Purpose
This document sets forth a waiver of liability and release of claims for any individual, organization, or entity (“Participant”) who donates, receives, or participates in the activities and services of The Body of Christ – Missouri (“Organization”).
2. Acknowledgment of Risk
The Participant acknowledges that engaging in volunteer activities, donating or receiving goods or services, or interacting through the Organization may carry inherent risks, including but not limited to:
- Physical injury
- Property damage
- Emotional distress
- Illness or exposure to infectious disease
- Serious injury or death
These risks may arise from physical labor, equipment or material use, transportation, environmental hazards, or the acts or omissions of other participants.
3. Release of Liability
To the fullest extent permitted by law, the Participant knowingly and voluntarily releases, waives, and discharges The Body of Christ – Missouri, its directors, officers, staff, volunteers, agents, and affiliates from any and all liability, claims, demands, or causes of action, including those arising from:
- Personal injury, illness, or death
- Property damage or financial loss
- Negligence or misconduct by other volunteers or aid recipients
- Use or misuse of donated goods or services
- Delays, cancellations, or unfulfilled service requests
This release applies even if the injury or death is alleged to have been caused in whole or in part by the negligence of the Organization.
4. Hold Harmless Clause
The Participant agrees to indemnify and hold harmless the Organization from any and all third-party claims, lawsuits, or liabilities that may result from:
- Their own acts or omissions
- Breach of the Code of Conduct
- Damage caused during a volunteer activity or as a result of donated goods
5. Assumption of Responsibility
The Participant certifies that they:
- Are voluntarily participating with full knowledge and acceptance of the risks involved
- Assume full responsibility for their conduct, safety, and outcomes
- Have read and agreed to all Codes of Conduct (Volunteer or Aid Recipient)
6. Severability
If any provision of this Agreement is found to be invalid, the remainder shall remain in full force and effect.
7. Governing Law
This Agreement shall be governed by the laws of the State of Missouri.
8. Signature & Consent
By signing below, I affirm that I have read, understood, and voluntarily accept this Liability Waiver & Release Agreement, including the acknowledgment of potential risks, including death.
